Privacy Policy of The Bunkier Sztuki Gallery of Contemporary Art in Krakow
In fulfilment of the controller’s obligations under art. 13
and 14 of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (hereinafter: ‘General Data Protection Regulation’), please be advised that the Gallery of Contemporary Art in Krakow has prepared the following information for those whose data it processes. The purpose of the provision of information by the Gallery is to enable you to exercise the rights set out in the General Data Protection Regulation, i.e. in particular the right of access, the right of rectification, erasure and the other rights set out in the General Data Protection Regulation.
Information on the processing of personal data by The Bunkier Sztuki Gallery of Contemporary Art in Krakow
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (hereinafter: ‘General Data Protection Regulation’), the Contemporary Art Gallery Bunkier Sztuki in Krakow, as the controller of personal data, informs:

3 Your personal data, including your name, email address, telephone number, will be processed for:
newsletter subscriptions, necessary for the establishment of cooperation and for the proper implementation of our cultural, educational and service offerings, including electronic contact and the processing of orders placed, bookings, the execution of concluded contracts, on the basis of art. 6 para. 1(b) of the General Data Protection Regulation, to comply with legal obligations incumbent on the Controller, on the basis of art. 6 para. 1(c) of the General Data Protection Regulation – for tax and accounting purposes, to fulfil the obligation to document the work of the Gallery, resulting from the legitimate interests pursued by the Controller, on the basis of art. 6 para. 1(f) of the General Data Protection Regulation), that is:
- for the purpose of marketing the Administrator’s services,
- for the establishment, defence and redress of claims,
- for the purposes of compiling summaries, analyses and statistics for the Administrator’s internal use, which includes reports, marketing research, analysis of the services offered and their development,
- for administrative purposes, as well as for network and information security.
4 The recipients of your personal data are:
- Gallery employees associated with the performance of the task/service for which personal data has been made available to the Gallery, entities supporting the operational performance of that task/service,
- entities servicing the Gallery’s equipment through which personal data is processed; entities providing and maintaining software used to process personal data, of which the Gallery is the Controller;
- entities to which records are handed over for destruction at the end of their retention period;
- entities providing consultancy, advisory, auditing, legal, tax and accounting assistance to the Administrator, inspection bodies.
5. Personal data will be kept until
the completion of the task/service, the performance of the contract and until the end of the period of limitation of potential claims arising from the task/service or the contract; in the case of contracts, no less than for the period of archiving of the contract and contract-related documentation resulting from the Act on National Archive Resources and Archives of 14 July 1983. (Dz.U. of 2020, item 164) and the Regulation of the Minister of Culture and National Heritage on the classification and qualification of documentation, transfer of archival materials to state archives and the discarding of non-archival documentation of 20 October 2015. (Journal of Laws 2015, item 1743).
6. You have the right, in relation to your personal data, to the extent and subject to the exceptions under the General Data Protection Regulation
or other legislation, the right to:
- request access to personal data from the Controller,
- request the Administrator to rectify your personal data,
- request deletion of data,
- request the restriction of data processing,
- to object to the processing of personal data,
- data portability to the extent provided for in art. 20 of the General Data Protection Regulation,
- lodge a complaint with the President of the DPA if you consider that the processing of your personal data violates data protection legislation.
7. The provision of data is voluntary, but necessary for the purposes – tasks/services and contracts indicated above.
8. Transfer and sharing of personal data
The Bunkier Sztuki Gallery of Contemporary Art in Krakow, as the Administrator of the data, reserves the right to transfer or make available the personal data of the Users whose data it administers to third parties in the event that:
- the user consents to it, or it is justified by law, or it is necessary for the provision of the service,
- this will be in connection with the assertion of claims and the clarification of the circumstances of users’ unauthorised use of the electronically provided services.
Your personal data will not be subject to automated decision-making or profiling.
Your personal data will not be transferred to third countries.
9. Data security
The controller shall ensure the security of personal data by means of appropriate technical and organisational measures aimed at preventing unlawful data processing.
In addition, the Administrator shall take special care to ensure that personal data are:
- correct and processed in a lawful manner;
- accurate and up-to-date;
- not kept longer than necessary;
- securely processed and stored.
10. Changes
The Bunkier Sztuki Gallery of Contemporary Art in Krakow reserves the right to make changes to the Privacy Policy by publishing the current text on the Website, at: https://bunkier.art.pl/
